    The Government Shutdown and Your Taxes IRS Update:

    The government shutdown that took place on October 1 left everyone with questions about how the shutdown will impact them.
    If you are one of the taxpayers that filed an extension, you may be wondering if the shutdown impacts filing your taxes.
    Don’t worry. We have you covered and have answers to your burning questions:

    Should I still file my extended tax return in light of the shutdown?
    Yes, you still need to file your tax return by the October 15th extended deadline. E-filing your return is the fastest way to have your tax return processed. Returns filed by mail will not be processed until after the shutdown is over. Acknowledgements will be issued by the IRS for e-filed accepted tax returns.

    You said paper filed returns will not be processed, but I have to mail mine. Will it be considered timely filed?
    Yes, although paper tax returns will not be processed until after the shut down is over, the postal service will still post mark your paper filed return. Any tax return postmarked by the due date will be considered filed on time by the IRS.

    Will the IRS shutdown exclude me from late filing penalties if I don’t file by October 15?
    No, the IRS still requires that you file your tax return by the extended deadline.

    I owe money on my 2012 taxes, what should I do?
    You should submit the balance owed electronically when you e-file your taxes. Payments received will still be posted to your account.
    If you have a previous balance due, you should submit the payment as you normally do.

    Will the government shutdown affect my tax refund?
    If you e-file your tax return, the IRS will still process your tax return as it normally would. If you are due a tax refund, it will be issued when the shutdown is over.

    Can I still check the status of my tax refund?
    If your tax return was processed before the shutdown, you can use “IRS Where’s My Refund?” to check the status of your tax refund. If you e-filed your tax return after the shutdown your e-filed tax return will be processed, however you will not be able to check the status of your refund until after the shutdown is over.

    IRS introduces simplified method for claiming home office deduction
    The IRS has announced a new optional safe harbor method, effective for tax years beginning on or after January 1, 2013, for individuals to determine the amount of their deductible home office expenses (IR-2013-5, Rev. Proc. 2013-13). Being hailed by many as a long-overdue simplification option, taxpayers may now elect to determine their home office deduction by simply multiplying a prescribed rate by the square footage of the portion of the taxpayer’s residence used for business purposes.

    The IRS cites that over three million taxpayers in recent tax years have claimed deductions for business use of a home, which normally requires the taxpayer to fill out the 43-line Form 8829. Under the new procedure, a significantly simplified form is used. The new method is expected to reduce paperwork and record keeping for small businesses by an estimated 1.6 million hours annually, according to the IRS. The new optional deduction is limited to $1,500 per year, based on $5 per square foot for up to 300 square feet.

    The simplified method is not effective for 2012 tax year returns being filed during the current 2013 filing season, but it will become effective for 2013 tax year returns filed in 2014. Taxpayers may want to investigate now whether they could benefit from the election for the 2013 tax year. Acting IRS Commissioner Steven Miller advised upon announcement of the safe harbor that “The IRS … encourages people to look at this option as they consider tax planning in 2013.” A final decision on the election need not be made until 2014, when 2013 returns are filed.

    1099-K Reporting Requirements for Payment Settlement Entities
    Beginning in January, 2012, payment settlement entities (PSEs) are required by the Housing Assistance Tax Act of 2008 to report on Form 1099-K the following transactions:
    All payments made in settlement of payment card transactions (e.g., credit card);
    Payments in settlement of third party network transactions IF:
    -Gross payments to a participating payee exceed $20,000; AND
    -There are more than 200 transactions with the participating payee.
    Filing Deadlines & Procedures
    Your 1099-Ks are due to merchants by January 31, 2013. Electronically filed 1099-Ks are due to the IRS April 1, 2013 (normally March 31), while paper 1099-Ks are due February 28, 2013.
    File your 1099-K electronically through the FIRE (Filing Information Returns Electronically) option. For information, review Publication 1220 (PDF). If you are considering filing on paper, review General Instructions for Certain Information Returns.
    Verification Processes

    TIN Matching Program
    Use the IRS Taxpayer Identification Number (TIN) Matching Program to ensure the Forms 1099-K you submit have the correct TIN. The program permits you to verify the TIN furnished by the taxpayer before you file the Forms 1099-K.
    Name Control
    The name control (a sequence of characters derived from a taxpayer’s name) and TIN on an electronically filed return must match our records.     FBAR – FOREIGN BANK ACCOUNT REPORTING
    • Compliance Requirement: Any signer on a foreign bank account not opened in the United States, including any accounts setup by relatives, that you are a signer on even though it may not be your nt and you have access to, and at any time during the year has had a balance that exceeded $10,000 U.S. dollars.
    • Reporting Requirement: Complete form TD F 90-22.1
    o To file form correctly, 12 monthly statements are needed for the tax year being reported on to determine the highest balance in the account during the year. The financial institution’s address, account number, and type of currency must accompany these statements.
    o The IRS does have the ability to look back 6 years on foreign accounts. If there was a filing requirement within the last 6 years that was not met, back years must be filed under the amnesty program setup by the IRS.
    • Deadline: June 30th – the form must be RECEIVED NOT MAILED to the Detroit IRS office for processing by the deadline date each year.
    • Penalty For Failure to Preparer: Could result in a penalty as high as 300% of the highest account balance in the past 6 years

    FATCA – Foreign Account Tax Compliance Act
    • Compliance Requirement: Foreign bank or financial accounts that you have signing authority over that include foreign cash, foreign stocks, foreign bonds, foreign mutual funds, financial interest in a foreign partnership, trust, corporation or any other entity, foreign real estate, foreign collectibles, and foreign business or personal property that include cars, antiques, jewelry, art, machinery, fixtures & equipment.
    • Reporting Requirement: Form 8938 for assets that value exceeds $50,000 for single and $100,000 for married. There is no dollar value threshold for the reporting of foreign trusts, partnership or corporations because these must be reported in all cases. In addition, forms 8939, 3520, 5471, 8621, 8865 & 8891 may need to be filed depending upon the type of income, the source, and location of the asset.
    • Deadline: Immediately – the newly released forms require both a 2011 and 2012 filing requirement.

    The intent of the US government in enforcing the foreign bank and asset reporting requirements is to discourage tax cheats from hiding un-reported income overseas and to crack down on money laundering. This includes money laundering that supports terrorism.

    The U.S. Government forced UBS (United Bank of Switzerland) which is a large financial institution here and aboard to turn over account information on all Americans and permanent residents of the United States. So far, year to date the IRS has imposed $5.2 Billion dollars in fines and are only 20% along in the processing of these accounts. With legislation of the federal government and the number of foreign banks doing business (75% of the World’s banking goes through the U.S.) in the U.S. there is no telling how far the reach of the IRS is.     New IRS Guidance on Health Care Employer Mandate Looks to 2014 Start Date

    Under the new health care law, starting in 2014, “large” employers with more than 50 full-time employees will be subject to stiff monetary penalties if they do not provide affordable and minimum essential health coverage. With less than eleven months before this “play or pay” provision is fully effective, the IRS continues to release critical details on what constitutes an “applicable large employer,” “full-time employee,” “affordable coverage,” and “minimum health coverage.” Most recently, the IRS issued proposed reliance regulations that provide employers with the most comprehensive explanation of their obligations and options to date.

    Background

    Under the Patient Protection and Affordable Care Act (PPACA) the federal government has made it possible for certain workers who do not otherwise have access to affordable health insurance coverage to obtain a tax credit that would help them pay the costs of their health care premiums. This credit applies to low-income workers whether employed by a small, mid-size or large employer or self-employed. Under Code Sec. 4980H as added by the PPACA, however, an “applicable large employer” is subject to a shared responsibility payment (an assessable payment) after December 31, 2013 if any of its full-time employees are certified to receive an applicable premium tax credit or cost-sharing reduction and either:

    • The employer does not offer to its full-time employees and their dependents the opportunity to enroll in minimum essential coverage under an eligible employer-sponsored plan (Code Sec. 4980H(a)); or
    • The employer offers its full-time employees and their dependents the opportunity to enroll in minimum essential coverage under an eligible employer-sponsored plan that with respect to a full-time employee who has been certified for the advance payment of an applicable premium tax credit or cost-sharing reduction either is unaffordable relative to an employee’s household income or does not provide minimum value (Code Sec. 4980H(b)).

    The Code Sec. 4980H(b) penalty applies to coverage that is “unaffordable,” meaning that the coverage costs more than 9.5 percent of the employee’s household income. Since employers may not be able to determine household income, the proposed regs provide three affordability safe harbors: the Form W-2 safe harbor (based on employee wages); the rate of pay safe harbor (based on hourly or monthly pay rates); and the federal poverty line safe harbor, the IRS explained.

    The employer cannot be liable under both Code Secs. 4980H(a) and 4980H(b).
